This is proposed for COVID-19 here in California. It is incredibly hard to comment on this bill below without getting boiling mad.
I cannot think of anything more chilling for your health than a doctor who can only follow approved protocols, most of which are for profit, not health. And all too often based on what would not pass the giggle test for real science.
Science is debate and competing ideas and deviating from the norm to try things. It requires creativity and an active mind. Real science is messy, with lots of dead ends, but it is directionally accurate and the only system that gets you somewhere good in the end If it is allowed to work. Consensus is the enemy of science; it crushes creativity and demands conformity. The bill below seeks the force of law to destroy science. Around COVID only for this trial balloon effort, but if it passes, there will be follow-on bills for everything.
If one authority can decide what “misinformation” is by edict, then science is dead. Because “consensus” is all about power, not about science. And the consensus is often wrong. And in this country, a very small number of unelected bureaucrats decide what “the science” is—as anti-science as it can possibly get.

AB 2098, as introduced, Low. Physicians and surgeons: unprofessional conduct. Existing law provides for the licensure and regulation of physicians and surgeons by the Medical Board of California and the Osteopathic Medical Board of California. Existing law requires the applicable board to take action against any licensed physician and surgeon who is charged with unprofessional conduct, as provided. This bill would designate the dissemination or promotion of misinformation or disinformation related to the SARS-CoV-2 coronavirus, or “COVID-19,” as unprofessional conduct...
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. The Legislature finds and declares all of the following:
(a) The global spread of the SARS-CoV-2 coronavirus, or COVID-19, has claimed the lives of over 5,000,000 people worldwide, including nearly 75,000 Californians.
(b) Data from the federal Centers for Disease Control and Prevention (CDC) shows that unvaccinated individuals are at a risk of dying from COVID-19 that is 11 times greater than those who are fully vaccinated.
(c) The safety and efficacy of COVID-19 vaccines have been confirmed through evaluation by the federal Food and Drug Administration (FDA) and the vaccines continue to undergo intensive safety monitoring by the CDC.
(d) The spread of misinformation and disinformation about COVID-19 vaccines has weakened public confidence and placed lives at serious risk.
(e) Major news outlets have reported that some of the most dangerous propagators of inaccurate information regarding the COVID-19 vaccines are licensed health care professionals.
(f) The Federation of State Medical Boards has released a statement warning that physicians who engage in the dissemination of COVID-19 vaccine misinformation or disinformation risk losing their medical license, and that physicians have a duty to provide their patients with accurate, science-based information.
(g) In House Resolution No. 74 of the 2021–22 Regular Session, the California State Assembly declared health misinformation to be a public health crisis, and urged the State of California to commit to appropriately combating health misinformation and curbing the spread of falsehoods that threaten the health and safety of Californians.SEC. 2. Section 2270 is added to the Business and Professions Code, to read:
2270. (a) It shall constitute unprofessional conduct for a physician and surgeon to disseminate or promote misinformation or disinformation related to COVID-19, including false or misleading information regarding the nature and risks of the virus, its prevention and treatment; and the development, safety, and effectiveness of COVID-19 vaccines.
(b) The board shall consider the following factors prior to bringing a disciplinary action against a licensee under this section:
(1) Whether the licensee deviated from the applicable standard of care.
(2) Whether the licensee intended to mislead or acted with malicious intent.
(3) Whether the misinformation or disinformation was demonstrated to have resulted in an individual declining opportunities for COVID-19 prevention or treatment that was not justified by the individual’s medical history or condition.
(4) Whether the misinformation or disinformation was contradicted by contemporary scientific consensus to an extent where its dissemination constitutes gross negligence by the licensee.
(c) For purposes of this section, the following definitions shall apply:
(1) “Physician and surgeon” means person licensed by the Medical Board of California or the Osteopathic Medical Board of California under Chapter 5 (commencing with Section 2000).
(2) ”Board” means the Medical Board of California or the Osteopathic Medical Board of California, as applicable.
(d) Section 2314 shall not apply to this section.
WIND: is it “misinformation” to declare that natural immunity is better than vaccination? Just one example of how the consensus is a suppression of science. That is what this bill tries to call unprofessional conduct: facts.
Big Pharma and Big Medicine adore this sledgehammer bill, if they are not sponsoring it outright. It will squeeze out the few remaining independent physicians.
The authors of this bill are smart in this way: very few doctors would tempt fate in following their own judgment when it means losing their medical license, or at the least being harassed by medical boards. The mere introduction of the bill is surely already chilling speed. Its potential passage means that any doctor can be targeted with a sledgehammer simply by offending peers with differing views on COVID treatment. It is designed to make life hell for any doctor who dares to step outside the mainstream narrative. A sort of rule by CNN.
These legislators are of course elected. But there is some justice in it: people stupid enough to vote these totalitarian legislators into office deserve the bad health and outcomes that will result. But the rest of us do not.
Super high death rate in USA — why?
Why does the USA have one of the highest COVID death rates in the world, by far? Simple: the refusal to allow doctors to try promising drugs for preventive and early treatment of COVID—one of the great tragedies of the pandemic.
Incredibly: no treatment until hospitalization, whereupon patients are poisoned with hyper-toxic Remdesivir and/or put on a ventilator to die. Which they did and do, in droves. Or given extremely dangerous monoclonal antibody experimental drugs that don’t work. THAT farce and theatre was our COVID strategy, because it was profitable. None of it worked but it made a lot of money for some. Only the lucky ones survived. THAT is why a million Americans died instead of 1/4 million (if you can believe the GIGO statistics). It need not have been that way. There should have been 1/4 that many deaths. But the official guidance guaranteed those deaths would happen, by suppressing science.
Had doctors been allowed to test things, we would have very quickly arrived at what works and what does not, without the hyper-politicized crap dished out along the way.
Vaccines were and are a quintuple disaster
Vaccines might have saved some and might have been appropriate for some age groups. Vaccines did (1) not stop infections, (2) did not stop transmission, (3) appear to alter DNA in spite of CDC claims otherwise, (4) might have made COVID worse for some, (5) are the likely cause for huge increased in mortality among the young, (6) might be responsible for surges in other deadly diseases such as RSV.
The control groups were broken early on, so we can never know for sure just how dangerous the COVID vaccines are/were.
I am lucky to have an independent personal physician that still exercises his own judgment. It’s a hard road for a physician. While he is “conventional”, he is willing to consider possibilities that none of my other doctors will and to do tests that might show something useful. And while plenty of things stump him, I at least know he will try his best. That matters more than just about anything.
My experience at a major health organization is very different: robotic care that see me as a database entry. The physicians there must follow carefully scripted approved protocols. Try having Long-Haul COVID with an organization like that! The stunning ignorance of most physicians along with disinterest in problem-solving is enervating, along with the unwillingness to do anything deviating “standard of care”. That is the reality now for most care.
It is an unspeakably demeaning experience to be reduced to a set of numbers, a database entry, one that looks up which Big Pharma chemicals are right for you (hint: follow the money).
Medical tyranny for your doctor, which means for you

One bureaucrat claiming “I am the science” ought to tell you all you need to know. Stifling doctors and their immense knowledge and experience base in favor of central-planning bureaucrats has been a proven strategy for 50 years for harming public health. Now the proposal is to double-down on that.
Constitutional
If this is not suppression of free speech, then nothing is? Free speech only matters when it comes to the right to say what is unpopular, divisive, unlikeable, not in accordance with the norm. That means doctors have the right to use their judgment and most of all, to express it. And it means that patients have the right to take care of their health as they see fit.
Dangerously anti-science
Science combats actual falsehoods with evidence; it does not hand them down from on high. Science has no need to suppress viewpoints.
An official view is the very antithesis of science. An consensus is the very antithesis of science. And in medical science there are so many confounders and variables multiplied by so many vested interests that there is almost nothing that
Dangerously anti-progress
All medical progress has come from trying new approaches. When something works, do more of it. When something does not work, get the CDC and Dr Fauci to approve it.
Science requires free inquiry. That cannot happen via central planning.
Nothing could be more dangerous to public health than having a faceless bureaucracy dictate the truth. The proof of that is self evident already with COVID, where so many died needlessly (by suppressing all pre-hospital treatment), and many times more will die from the public policies enacted.
Virtually everything claimed about COVID-19 has been proven to be false (the opposite), or at best a half-truth.
Consensus = Follow the Money
Consensus viewpoints are always driven by vested interests eg financial ones. The medical industry is a huge cabal of faux regulators, Big Pharma, Hospitals, Medical Associations, primary investigators rewarded for the desired research results, guild socialism, etc. These entities work seamlessly to make public health worse and worse.
Misinformation STARTS at the CDC/FDA
From the start, the CDC/FDA lied about everything, and they continue to lie. From the start, they failed to collect useful data and the data collected was hidden or suppressed, and still is. From the start they over-efforted to create a narrative around “no early treatment”.
There is ZERO real science at the CDC because by definition real science demands full disclosure and vigorous debate and honest data and the right data. What we witnessed was a suppression of debate with active campaigns to discredit the best world class minds out there.
So now these nitwits in California want to outlaw science around COVID.
Only children and idiots can believe that the CDC/FDA/NIAID/etc are unbiased arbiters of truth. These agencies and their Big Pharma overlords are ruthless bureaucracies with vested financial interests for all involved. Public health is a pretext, and has only and everything to do with follow the money.
“Public health”is a foil for a vast profit-making engine which will not fund anything that might challenge the hegemony, or bring costs down. Improving public health outcomes is to be avoided at all costs, because the stricken are grist for the profit mill of the modern medical-industrial complex. Witness the surging rates of disease and disability at all age groups. Witness the total failure to do real dietary research, real research on toxins, real research on vaccines (especially combined). Instead we get $10K drug treatments that do not work, or actively harm.
One neck of humanity to strangle... didn’t Stalin say he wished for that? That’s what this bill is about.
